By creating an account, making a booking, or using any feature of Ruppell (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
Ruppell is operated by Premier Ruppell Holdings LLC, a Wyoming limited liability company doing business as Ruppell ("Ruppell," "we," or "platform"), and is an adventure activity booking platform that connects users with independent third-party adventure operators ("Operators"). Ruppell facilitates discovery, booking, and payment for activities, but is not itself the operator of any listed activity and does not guarantee the availability, safety, or quality of any activity beyond what is disclosed in each listing.
You must be at least 18 years old to create an account or make a booking. Many activities have independent minimum age, weight, health, or fitness requirements set by the Operator; it is your responsibility to confirm eligibility before booking. Participants under 18 require the written consent and supervision of a parent or legal guardian.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at legal@getruppell.com of any unauthorized use. You agree to provide accurate and complete information when creating your account and to keep it current.
All prices are shown in U.S. dollars and are subject to applicable taxes and fees calculated at checkout. Payment is due in full at the time of booking. A confirmed booking constitutes a contract between you and the Operator; Ruppell facilitates the transaction and payment but is not a party to the activity contract itself. Ruppell charges a platform service fee that is included in the displayed price.
Adventure and thrill activities listed on this Service carry inherent risks, including the risk of serious injury or death. By booking an activity, you acknowledge and accept these risks as further described in our Liability Waiver & Assumption of Risk Agreement, which you must separately acknowledge before completing checkout.
Cancellation and refund eligibility vary by activity and are described in our Cancellation & Refund Policy and on each individual listing. Please review the applicable policy before booking.
Ruppell includes community features that allow you to post content, including stories, tips, photos, and events ("User Content"). By submitting User Content, you grant Ruppell a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute that content on the platform. You represent that you own or have the necessary rights to any content you post, that it does not violate any third party's rights, and that it complies with these Terms. Ruppell reserves the right to remove any User Content at its sole discretion, without notice, for any reason including content that is unlawful, harmful, false, obscene, or otherwise objectionable. You are solely responsible for your User Content and any consequences of posting it.
You agree not to: (a) post false, misleading, or fraudulent content; (b) harass, threaten, or harm other users or Operators; (c) upload content that infringes any copyright, trademark, or other intellectual property right; (d) attempt to circumvent any security or authentication measure; (e) use the Service for any unlawful purpose; (f) impersonate any person or entity; or (g) use automated tools to scrape, crawl, or otherwise extract data from the Service without written permission.
All content on the Service created by Ruppell — including text, graphics, logos, and software — is the property of Ruppell or its licensors and may not be reproduced without written permission. You retain ownership of User Content you submit, subject to the license granted above.
THE SERVICE AND ALL LISTED ACTIVITIES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. RUPPELL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUPPELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR PARTICIPATION IN ANY LISTED ACTIVITY. RUPPELL'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE OR PARTICIPATION IN ANY LISTED ACTIVITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF THE TOTAL AMOUNT YOU PAID RUPPELL IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100).
You agree to indemnify and hold harmless Ruppell and its affiliates, officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your participation in a listed activity, or your breach of these Terms. For third-party claims, Ruppell will give prompt notice, with delay excusing performance only to the extent materially prejudicial. You must provide counsel reasonably acceptable to Ruppell and may not settle without Ruppell's written consent if the settlement admits its fault, imposes obligations on it, or fails to fully release it.
Any dispute arising from these Terms or your use of the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Class action and jury trial rights are waived to the fullest extent permitted by law. The Federal Arbitration Act governs this arbitration provision. Judgment on the award may be entered in any court with jurisdiction; either party may seek temporary injunctive relief from a court to preserve the status quo pending arbitration.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
We may update these Terms from time to time. Material changes will be communicated by email or an in-app notice. Changes do not retroactively alter bookings already confirmed before the effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
