You must acknowledge this Agreement at checkout for every booking. This Agreement covers all participants included in your booking, including minors for whom you are the parent or legal guardian.
Adventure and thrill activities booked through Ruppell — including but not limited to skydiving, bungee jumping, whitewater rafting, rock and ice climbing, paragliding, surfing, scuba diving, aerial activities, motorized activities, high ropes and aerial courses, axe throwing, and similar activities — involve inherent and significant risks, including the risk of serious bodily injury, illness, permanent disability, property damage, and death. These risks may result from your own actions, the actions of others, equipment condition or failure, weather, terrain, water conditions, or the acts or negligence of the activity Operator or their staff.
You acknowledge that your participation in any booked activity is entirely voluntary and that you choose to participate with full knowledge of the risks described in this Agreement and any additional disclosures provided by the Operator.
You knowingly and freely assume all risks — both known and unknown — arising from your participation in any activity booked through Ruppell. This assumption of risk includes, without limitation, risks arising from the negligence of the Operator, their employees, or Ruppell, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, you release, waive, discharge, and covenant not to sue Ruppell (and its affiliates, officers, employees, and agents) and the applicable Operator (and their owners, employees, guides, and agents) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury — including death — that may be sustained by you or any participant in your booking during or in connection with participation in a booked activity, whether caused by negligence or otherwise.
You represent that you and each participant in your booking are physically fit and have no known medical condition that would prevent safe participation in the selected activity. You acknowledge that each Operator may have additional health, age, and fitness requirements, and that it is your responsibility to review and comply with them. You authorize the Operator to seek emergency medical treatment on behalf of any participant if needed; associated costs are your responsibility.
You agree to indemnify and hold harmless Ruppell and the applicable Operator from any loss, liability, damage, or cost (including reasonable attorneys' fees) arising from your participation or that of any participant in your booking, including claims made by third parties. For third-party claims against Ruppell or the Operator, the affected party will give prompt notice, with delay excusing performance only to the extent materially prejudicial. You must provide counsel reasonably acceptable to the affected party and may not settle without its written consent if the settlement admits its fault, imposes obligations on it, or fails to fully release it.
You grant Ruppell and the applicable Operator a non-exclusive, royalty-free license to use photos or video taken during your activity for promotional and marketing purposes, unless you provide written notice to the Operator before your activity date requesting exclusion.
If any provision of this Agreement is found unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
This Waiver is between you and Ruppell (Premier Ruppell Holdings LLC, a Wyoming limited liability company), 144 E. 44th St. Suite 106 #1009, New York, NY 10017 · (888) 460-2282, and the Operator running your activity. Questions: legal@getruppell.com.
By checking the acknowledgment box at checkout, you confirm that you have read, understood, and agree to be bound by this Liability Waiver & Assumption of Risk Agreement on behalf of yourself and all participants included in your booking. Note: Waiver enforceability varies by state. Ruppell recommends consulting a licensed attorney in your jurisdiction to ensure this waiver meets all applicable local requirements.
